These Terms of Service ("Terms") govern your access to and use of the GISOwl website at gisowl.com, the GISOwl web application, mobile apps and API (together, the "Service").

In these Terms, "GISOwl", "we", "us" and "our" refer to Ilya Sidorov, Individual Entrepreneur (IE). "You" means the person or organization using the Service.
By creating an account, purchasing a subscription or otherwise using the Service, you agree to these Terms, our Privacy Policy and our Refund Policy. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.
You must be at least 16 years old, or the age of legal majority where you live if that is higher, to use the Service.
GISOwl is a web-based platform for creating, analyzing and sharing maps and geospatial data. Depending on your plan, the Service includes interactive maps, data upload and import, dashboards, annotations, sharing and collaboration, a field data collection app, the Owl AI assistant and a REST API. The features, limits and prices of each plan are described on our Pricing page.
We may improve, change or discontinue features from time to time. If we remove a feature that is material to a paid plan you are subscribed to, we will notify you in advance.
You agree to provide accurate information when you register and to keep it up to date. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at hello@gisowl.com if you suspect unauthorized use of your account.
Plans. We offer a free plan and paid subscription plans billed monthly or annually, as listed on our Pricing page. Prices are shown in US dollars.
Payment processing. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Applicable sales tax or VAT is calculated and collected at checkout.
Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annual) until you cancel. The payment method on file is charged at the start of each new period.
Free trials. Where we offer a free trial, you will not be charged during the trial. If you do not subscribe to a paid plan before the trial ends, your workspace may be limited or become read-only.
Price changes. We may change our prices. Any change to the price of your existing subscription will take effect from your next renewal, and we will tell you at least 30 days in advance so you can cancel before it applies.
You can cancel your subscription at any time from your account settings or by emailing hello@gisowl.com. Cancellation takes effect at the end of your current billing period, and you keep access to paid features until then. No further charges will be made after cancellation.
Refunds are handled under our Refund Policy, which includes a 14-day money-back guarantee.
You keep all rights to the data, maps, files and other content you upload to or create in the Service ("Your Content"). You grant us a limited license to host, store, process and display Your Content only as needed to provide and support the Service for you and the people you choose to share it with.
You are responsible for Your Content and confirm that you have the rights needed to upload and use it. We do not sell Your Content and do not use it to train AI models.
You are responsible for making sure that your use of the Service, and any use by your team members or the people you share maps with, complies with all applicable laws. You must not:
Plans include usage limits, such as storage, upload size and Owl AI requests, as described on our Pricing page. We may apply rate limits to keep the Service available for all customers. To run a load test against the Service, contact us at hello@gisowl.com at least two weeks in advance.
Owl AI generates answers, queries, map content and other outputs from the prompts and data you provide. You are responsible for your prompts and for how you use the outputs. You must not use Owl AI to create content that is illegal, infringes anyone's rights, or breaches section 8 of these Terms.
AI outputs can be inaccurate or incomplete. Review them before relying on them, especially for decisions with legal, safety, financial or environmental consequences. As between you and us, you own the outputs generated from Your Content. We may limit or block requests that we reasonably believe breach these Terms.
If you believe content in the Service infringes your rights, contact us at hello@gisowl.com and we will review it promptly.
The Service may include or connect to third-party services, such as basemap providers, external data sources, sign-in providers and AI model providers. Your use of those services may be subject to their own terms. We are not responsible for third-party services we do not control.
We work to keep the Service available and secure, but we do not guarantee that it will be uninterrupted or error-free. We may carry out maintenance that temporarily affects availability, and will try to schedule it to minimize disruption. Specific service levels apply only if agreed with us in writing.
We recommend that you keep your own copies of important data. You can export your data from the Service at any time while your account is active.
You may stop using the Service and delete your account at any time.
We may suspend or terminate your access if you materially breach these Terms, if payment for a paid plan fails and is not resolved, or if we are required to do so by law. Where reasonable, we will give you notice and an opportunity to fix the problem first.
We may also stop providing the Service as a whole by giving you at least 30 days' notice. In that case, we will refund the unused portion of any prepaid subscription fees.
After your account is terminated, we may delete Your Content after 30 days, unless the law requires us to keep it longer.
The Service, including its software, design and the GISOwl name and logo, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not give you any rights to them other than the right to use the Service as described here.
If you send us feedback or suggestions, we may use them without any obligation to you.
Except as expressly stated in these Terms, the Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement. Maps, analysis results and Owl AI outputs may contain errors, and you are responsible for checking them before relying on them.
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for intentional misconduct or gross negligence, or your rights as a consumer under mandatory law.
If you use the Service for business purposes, you agree to indemnify us against claims by third parties arising from Your Content or from your use of the Service in breach of these Terms or the law.
These Terms are governed by the laws of Georgia. Any dispute will be decided by the competent courts of Tbilisi, Georgia. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live, and you may bring a claim in the courts of that country.

We may update these Terms from time to time. The current version is always available on this page. If we make material changes, we will notify you by email or in the Service at least 30 days before they take effect. If you do not agree to the new Terms, you can cancel your subscription before they apply.
